Abstract

This paper discusses the regulations and provisions that comprise the disciplinary regime applicable to civil servants in Spain. The main regulations that govern this matter in Spain include the following: Spanish Royal Decree Real Decreto 33/1986, of January 10, approving the disciplinary regime regulations applicable to the civil servants of the State administration; Spanish Act Ley 39/2015, of October 1, on the Common Administrative Procedure of the Public Administrations; Spanish Act Ley 40/2015, of October 1, on the Legal Regime of the Public Sector; as well as the Spanish Royal Decree Real Decreto Legislativo 5/2015, of October 30, approving the revision of the Act that governs the Civil Servants' Basic Statute. The study also includes defining and exemplifying core concepts, such as special relationships and disciplinary power.
