Abstract
Within the disciplinary procedure for the imposition of sanctions for minor offenses committed by officials, there is a diversity of regulations that can pose numerous problems in relation to various legal aspects, such as the applicable principles, the procedure itself, deadlines, expiration, etc. that have raised quite a few doubts when it comes to maintaining a homogeneous position in the instruction and processing of the mentioned above by the Educational Inspection.
The present study tries to provide more clarity on the legal coverage regarding the principles and the procedure to be followed in processing the disciplinary procedures initiated for minor offenses, indicating the responses they offer in this regard regulations, jurisprudence and majority doctrine.
It will also be analyzed in this study the impact the entry into force of Law 39/2015, of October 1st, of the Common Administrative Procedure of Public Administrations, has had on the issue raised as well as the Law 40/2015, of October 1st, of the Legal Regime of Public Sector.
