Abstract
The existence of a regulation on data protection and transparency, in general, represents a step forward in the guarantees of citizens in a democratic context like the one we live in. Data protection regulations tend to store or reserve those aspects that must fall within the confidential field, while the transparency regulations intend to make visible those issues that guarantee that the management of the public sphere is carried out effectively, correctly and according legality criteria. But it is not always easy to reconcile both aspects.
Its application to the educational field undoubtedly presents peculiarities that need to be taken into consideration and which should be considered, since a thoughtless or inappropriate application of these generic norms in our context can cause considerable difficulties.
The introduction of new technologies in the educational field makes this reflection even more necessary, since they make this conflict between privacy and dissemination in public management more evident, if possible. This article is based primarily on the study of legal and regulatory sources and on resolutions of the competent bodies on data protection and transparency.
