COMPLAINT FILED BY THE FATHER OF A STUDENT OF 1ST OF BACCALAUREATE, ON THE OCCASION OF THE DISCIPLINARY PROCEEDINGS INITIATED AGAINST HIS DAUGHTER

Abstract

BACKGROUND OF THE CASE

On March 25, 2013, the student R.V.G., in 1st year of Bachiller, was expelled from the English class for making several noises that prevented the normal development of the class by the teacher of the subject. Subsequently, and as a sign of disagreement with the measure adopted, the student throws water out the window and wets the teacher and the work materials that were on the table.
As of this fact, the teacher does not let him enter the English class until the director takes some precautionary measure and also the Philosophy and Mathematics teachers, out of solidarity with the English teacher, adopt the same measure, so the student cannot attend these classes.
On March 27, 2013, the director agrees to open a disciplinary file for serious misconduct and appoints an instructor.
On April 10, 2013, at the request of the Coexistence Commission, the Instructor proposes as a precautionary measure the temporary suspension of the right to attend the center for 7 days, which is communicated to the student the same day.
On May 1, 2013, the director resolved the file and proposed the definitive disqualification to study at the center for the student R.V.G.
On date XXX, Mr. B.V.C., father of the 1st year high school student R.V.G. in the IES XXX, of Valencia, claims through an appeal, addressed to the Territorial Director, the procedure of investigation of the file initiated to his daughter, for not adjusting to Law neither in substance nor in form and for what requests the annulment of said procedure.

ACTS

Before the appeal filed by Mr. B.V.C. at the Territorial Directorate, the Territorial Director requests a detailed report of the facts from the Inspectorate and a response to the allegations presented by the father and a clarification of the procedure carried out by the center.
Among the allegations raised by the father are the following:

The father has requested interviews with several teachers at the center and has never been attended to as they have been granted in the morning when he cannot attend due to his work and has also been treated with disrespect for the pejorative comments they have made about his daughter.
The director has executed the expulsion from the center without any written communication and also without providing him with a work plan to do at home while he is out of the center, which constitutes an illegality and harms his daughter.
Before the resolution proposal, the father presents allegations that are not answered and in addition the Director alters the Instructor's proposal and changes the expulsion of 20 school days into a definitive expulsion from the center.
The father has wanted to access the content of the file and has been denied by the board

For all these alleged facts, the father has requested the annulment of the procedure.
The inspector analyzes the facts and requests the open file from the student to verify how the events have unfolded and the steps that have been followed.
